As an accident victim, you have extensive rights. Many people don't know their full entitlements – here's what you're owed.

Free choice of assessor

You have the right to instruct an independent assessor of your own choosing. The other party's insurer must cover the costs. Do not allow the insurer to impose its own assessor on you.

Compensation claims

In addition to the repair costs, you are entitled to further claims: rental car costs or compensation for loss of use, market-related diminished value, assessor's fees, towing costs and a lump sum for incidental accident expenses. In the event of a total loss you are entitled to the replacement value less the residual value.

Legal support

In the case of a third-party liability claim, the other party's insurer also covers the legal fees. Particularly where payments are reduced or disputes arise, we recommend involving a lawyer specialising in traffic law.

Do I have to accept the expert the insurance company sends?

No – in a liability damage case, you have the legal right to freely choose your expert. The opposing insurance company may not dictate their own expert.

What costs must the opposing insurance reimburse in a liability claim?

All accident-related costs: repair costs, expert report costs, rental car costs or loss of use, diminished value, towing costs, accident cost lump sum, and attorney fees.

What can I do if the insurance company reduces my claim?

Consult an attorney specializing in traffic law. Their costs are also covered by the opposing insurance in liability damage cases.
